Changes to our Terms and Conditions and Frequently Asked Questions are made from time to time, and your continued use of our website following any change shall be deemed as your acceptance of such change. It is the user’s responsibility to regularly check our Terms and Conditions for changes.

These Terms and Conditions are governed by the laws in force in Victoria, Australia and you irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of Victoria, Australia and any courts, which may hear appeals from those courts.

      Élan Media Partners will pass on any information relating to suspected fraudulent activity to appropriate authorities
    • Partner Stores:
      With organizations that we operate but do not own, your information will be shared with that business. Please note, that we only go into partnerships with stores who have the same regard to Privacy as we do. We will not at any time share your financial information with the partner store.
    • Industry Groups:
      From time to time we provide statistical information about sales, trading patterns and navigation techniques to reputable third parties. This may comprise data collected about you and other users to form aggregate results. However, we will not provide any direct personal information that identifies you as our customer.
    • Verification of Accounts:
      We do use various details to verify information given to us by our members. At times, we use:
      • names on member accounts to compare with information on credit cards
      • we use member phone numbers and email addresses provided to us to communicate with customers about payments
      • we use member addresses to check against credit card billing addresses etc.
      • in cases where fraud or other crime is suspected, we do communicate with Police, Banks and other relevant authorities
      • Many of these checks are done manually and communication is handled carefully by a member of Élan Media Partners' own Customer Service team.
    • Lost login and Password details:
      Many account holders often forget details such as their passwords and so are able to request an email be sent to them notifying them of their password.
  5. Information Security
    • All information submitted to Videoezy.com is secured using Secure Sockets Layer (SSL)
    • Customer credit card details are only used to process payment and are not saved in the Videoezy.com system, we use eWAY to guarantee the best possible security for our online transactions. eWAY has multiple firewalls to protect important data and features 1024 bit data encryption. No credit card information is stored on Video Ezy's web servers.
    • Information sitting on the Videoezy.com website is protected by state-of-the-art encryption and firewall technology
  6. Accessing Your Information
    • Personal information provided by you can be viewed and changed by you if information provided is incorrect or out of date.
    • Videoezy.com provides you with the following tools to manage your information, the tools will evolve as the Videoezy.com website evolves:

  9. Membership

    An Videoezy.com account holder may not have more than one active account, whether this is by use of name, email address, an alias or combination thereof. If you breach this condition, you may be liable for the recovery of any benefits obtained this way, such as gift vouchers, promotional benefits and the value therein.
    Videoezy.com accounts are non-transferable. You may update, edit or terminate your account at any time. You agree to maintain and update the information as supplied by yourself to ensure accuracy at all times.
    As an Videoezy.com account holder, you are responsible for maintaining the confidentiality of your own membership account and password. You agree to take responsibility for all activities that occur under your account and password.

Product Information

Prices of goods and services and delivery and other charges displayed on the Videoezy.com website are current at the time of display. These prices are subject to variation without notice.

We will always attempt to be as accurate as possible with our product descriptions and pricing. However, we are unable to warrant that product descriptions or other content of the website is accurate, complete, reliable, current or error free.

If an error is discovered in the price of the item(s) you have ordered, we will inform you and issue a full refund as soon as possible. We shall be under no obligation to fulfil an order for an item which was advertised at an incorrect price, if the item(s) has been charged and not dispatched we will cancel and refund your order.
Some products on Videoezy.com may not be immediately available for dispatch from our supplier, due to circumstances beyond our control. However, where possible, we will advise you of any delay by advertising the release or campaign (sale) date accordingly. By submitting your order after being advised of such delays, you are accepting such timeframes into which the item/s will be shipped. If there are any changes in the release date to which you have previously accepted, we will endeavour to contact you as soon as possible.

Placing and Accepting Orders

Orders will not be dispatched until payment in full has been received and Videoezy.com is satisfied with the integrity of the order.

Without limiting the operation of any other Terms and Conditions herein, Videoezy.com is not responsible for any loss or damage caused by late delivery or cancellation of an order or a product.

Placement of an order by you constitutes an offer to enter into an agreement with us ("your offer"). We will email you an Order Confirmation for the sole purpose of confirming the details of your offer. Please note that our Order Confirmation does not constitute an acceptance of your offer or reflect the status of your order in any way.

Cancellation by Us

We reserve the right not to provide goods or services, terminate membership accounts, remove or edit content or cancel orders (or part thereof) at our sole discretion at any time. Without limiting the operation of any other Terms and Conditions herein, we will not be held liable for loss or damage arising from the exercising of these rights.

Cancellation by You

If you need to cancel an order, please contact us immediately by email at enquiries@videoezy.com.au. Our agreement with you only comes into existence once we have both confirmed your order and your payment has been processed. Once we have accepted payment for an order, cancellation of the order is within our sole discretion. Orders that cannot be cancelled will be subject to our terms, conditions and policies relating to Returns and Exchanges.

Delivery

It is your obligation to enter the correct delivery address details at the time of ordering. Should you enter the wrong address, we are not obliged to re-send the order to the correct address at our expense.

We will provide you with an estimated date for delivery of all parcels. While we make every effort to deliver by this time, all dates specified are estimates only. We have aligned ourselves with Australia Post who we believe will always do their best to deliver products by the estimated delivery date.

When you order products from Videoezy.com and the total value of an individual order is $60, you will receive free standard shipping on that order. This offer excludes bulky items – large DVD boxsets. We will sometimes also have a free shipping offer on a particular title. Please note free shipping is only available domestically via Surface Mail. We reserve the right to end or change this Free Shipping offer at any time.
Please note that if an item has been lost in transit, you must contact us within 30 days of the item being shipped from our warehouse in order to qualify for consideration for a replacement item. We will not dispatch a replacement item immediately. Replacement items will be dispatched according to our discretion.

Without limiting the operation of any other Terms and Conditions herein, we will not accept liability for any loss or damage arising from a late delivery.

Without limiting the operation of any other Terms and Conditions herein, you agree that late delivery does not constitute a failure of our agreement, and does not entitle you to cancellation of an order.

Without limiting the operation of any other Terms and Conditions herein, we will not accept liability for any loss or damage arising from items lost, stolen or damaged after delivery has taken place.

Returns & Exchanges

The item I received is not the item I ordered
Videoezy.com will:

  • Replace the item at no cost to you OR
  • Provide a full refund (including the cost of shipping) OR
  • Issue you with a Videoezy.com voucher (including the cost of shipping)

You must

  • Email us with your order number and which item/s you received within 14 days to be considered for an authorisation for returns (RA)
  • Have an RA in order to claim for a refund/replacement item

Please allow at least 14 days for a replacement item to be sent to you (please allow extra time if you are returning an item from an international destination). If you have not received your replacement item within 14 days of returning it to us, or your refund within 7 days, please contact our customer service team on enquiries@videoezy.com.au

I did not receive my order
Videoezy.com will email you an estimated date for delivery once the item is dispatched from our warehouse.
If you do not receive your order as advised, please contact our customer service team on enquiries@videoezy.com.au and include your order number.

We will then provide you with a claim form to lodge an investigation with our shipping partner. If the order is not located, we are not obliged to replace the order, although we may do so at our discretion.

As we are able to trace orders sent via Australian Air Express (for orders shipped within Australia), we would encourage you to select this shipping method for added security and peace of mind.

My order was delivered late
We will provide you with an estimated date for delivery of all parcels. While we make every effort to deliver by this time, all dates specified are estimates only. We have aligned ourselves with Australia Post and Australia Air Express who we believe will always do their best to deliver products by the estimated delivery date.

My order was damaged in transit
If your item was damaged between leaving our warehouse and arriving at your delivery address, Videoezy.com will

  • Replace the item at no cost to you OR
  • Provide a full refund (including the cost of shipping) OR
  • Issue you with a Videoezy.com voucher (including the cost of shipping)

You must:

  • Email us with your order number and the condition of your item/s within 14 days to be considered for an authorisation for returns (RA)
  • Have an RA in order to claim for a refund/replacement item

We will then:

  • Assess your application – we may ask for a photo of the item
  • If we authorise a return, we will email you an RA number and instructions for returning the item/s to us.

Please allow at least 14 days for a replacement item to be sent to you (please allow extra time if you are returning an item from an international destination). If you have not received your replacement item within 21 days of returning it to us, or your refund within 14 days, please contact our customer service team on enquiries@videoezy.com.au.

Damaged Case
Should you receive a cracked or damaged case, we will be happy to mail you a replacement. Simply contact our Customer Service Team and request a replacement.

The item I ordered arrived faulty or didn’t work as intended
If your item is found to be faulty, Videoezy.com will

  • Replace the item at no cost to you OR
  • Provide a full refund (including the cost of shipping) OR
  • Issue you with a Videoezy.com voucher (including the cost of shipping)

You must

  • Email us with your order number and the fault or problem with the item/s within 14 days to apply for an authorisation for returns (RA)
  • Have an RA in order to claim for a refund/replacement item

We will then

  • If we authorise a return, we will email you an RA number and instructions for returning the item/s to us.
  • Examine and test the faulty item/s (all products that are found to be non-defective will incur the delivery costs of returning the item to Videoezy.com)
  • If a product is deemed to be faulty, normal warranty conditions for that product apply.

Please allow at least 14 days for a replacement item to be sent to you (please allow extra time if you are returning an item from an international destination). If you have not received your replacement item within 21 days of returning it to us, or your refund within 14 days, please contact our customer service team on enquiries@videoezy.com.au.

I've changed my mind and no longer want the item I ordered
We are happy to exchange any unopened DVD within 14 days, provided the goods are returned in PRISTINE condition. A Return Authorisation will be approved at our discretion and all postage costs are to be incurred by the customer. If the product is damaged upon receipt in our warehouse, we are unable to accept the return and the item will be mailed back to you.

A processing fee of $2.00 will be incurred for each item which is returned. 

Once the returned item has been processed a refund will be issued less the $2.00 processing fee for each item.

I've had my item for a while, but it no longer works as described
We will assist where possible with the repair or replacement of faulty items. Where appropriate, we are also happy to work with our suppliers on your behalf or provide you with the contact information for the right people to speak to.

Video Ezy Online Gift Vouchers

Gift Voucher Terms and Conditions

  • Vouchers are redeemable at videoezy.com online store only and not redeemable in any bricks and mortar store.
  • Vouchers are in currency AUD
  • Vouchers may not be redeemed for the purchase of Gift Vouchers (you cannot purchase a Gift Voucher with another voucher)
  • The recipient of the Gift Voucher will receive the voucher details 24 hours after purchase.
  • One or more Gift Vouchers can be redeemed against an order.
  • If your order is less than the value of your Gift Voucher(s) the balance will remain on your Gift Voucher for redemption at a later date.
  • If the order exceeds the amount of the voucher, the balance must be paid by our available payment options.
  • Vouchers are partially redeemable and it is up to the bearer to use the full value within the validity period. Expiry Dates are provided on all Vouchers and unused portions will expire immediately after the stated expiry date. Any unused balance will not be refunded or credited when expired.
  • Videoezy.com is not responsible for the loss of Gift Vouchers.
  • Gift Vouchers are valid for 365 days after the purchase date
  • Videoezy.com Gift Vouchers are not redeemable for cash
  • We reserve the right to change any terms contained in these Terms of Use at any time. Changes to Terms of Use will be available on www.videoezy.com
  • If ineligible products are added to the cart - the Gift Voucher will only be applied to the eligible items.
  • Gift vouchers purchased in and valid for a bricks and mortar store are not redeemable on www.videoezy.com online store.

Suppliers

If you enter into a transaction through Élan Media Partners to purchase services or vouchers for those services supplied directly by a third party, Élan Media Partners is not responsible for the provision of those services or for any misunderstanding between you and the supplier.

In all arrangements involving the direct provision of services by third parties, Élan Media Partners accepts no liability of any kind in connection with or arising from such an arrangement.

ONLINE MEMBERSHIP TERMS AND CONDITIONS

These terms and conditions form the basis of the Video Ezy Online MEMBERSHIP. Information on how to enrol, the Registration and General Terms and Conditions for Participation form part of these terms and conditions.

The Video Ezy Website (VEW) has free membership online which, from time to time, offers special, bonuses and privileges to members who register their details online at www.videoezy.com.au

  1. Members
    1. VEW customers who wish to apply for a membership must register online at www.videoezy.com.au, and in doing so they agree to be bound by these terms and conditions. Only individuals may be members and may only hold one membership at any one time. Registrations submitted for membership to be registered under the names of two or more individuals or by corporations will not be accepted.
    2. Membership to the VEW is only open to residents of Australia.
    3. VE may reject or refuse any Registration at its discretion.
    4. VE may cancel any membership at any time without notice and for any reason, including (without limitation) if the member: fails to comply with these terms and conditions; supplies any misleading information or makes misrepresentations to VE, any participating VE stores, or any Rewards provider; dies or becomes bankrupt; fails to comply with the terms on which any reward or promotion is offered; or abuses any privilege accorded to the Member.
    5. A Member may terminate or cancel the VEW Membership at any time by emailing webmaster@videoezy.com.au
  2. Receiving bonus offers based on VEW Membership
    1. A Member who receives a Video Ezy bonus offer will by entering their Membership logon details online, receive the Bonus Offer with specific terms and conditions for each offer.
    2. A Member cannot combine a VEW Bonus Offer with any other VEW or VE Offers.
    3. Any Participating VE stores shall be entitled to assume, on presentation of a VEW bonus offer, that the presenter is the registered Member. Normal membership and hiring conditions in-store apply to all offers redeemed.
    4. Bonus Offers have no cash or monetary value and cannot be sold, transferred, assigned, or otherwise dealt with except in accordance with these terms and conditions.
  3. Variation or change to Terms and Conditions
    1. VE reserve the right to vary the terms and conditions of VEW membership, or suspend or terminate the Promotion at any time without prior notice.
    2. Without limiting clause 7.1, VE may at any time in its absolute discretion and without notice, cancel the VEW Memberships, introduce an expiry date for use of the Membership offers or make any other change to membership privileges.
    3. VE will endeavour to advise members of information about Promotions (such as any changes of the kind listed above), but VE will not be liable for any failure to do so.
  4. Notice
    1. Any notice to members will be posted to the member at the mail or email address appearing in VE records. Notices to VE shall be posted to PO Box 3531, Rhodes Shopping Centre, Rhodes NSW 2138 or to feedback@videoezy.com.au
  5. Limitation of Liability
    1. All conditions and warranties, whether express or implied and whether arising under statute or otherwise; as to the condition, suitability, quality, fitness or safety of any goods or services supplied under the Promotion are expressly excluded to the full extent permitted by law. Any liability VE may have to a VEW Member in respect of such goods or services which cannot be excluded is limited, where permitted, to supplying, or paying the cost of supplying, the goods or services again.
    2. VE is not liable for: any delay in issuing a Membership; any use of a Membership by a person other than the Member and any benefits derived from the use of the Membership by that other person (such as the receipt of a Bonus Offer); any correspondence between VE and the member lost or delayed in the mail or email; the suspension or termination of the promotion; any disruption to the promotion or any delay or inability to provide any Bonus Offer caused by circumstances beyond the control of VE.
  6. Privacy Policy
    1. VE respects your rights to privacy under the Privacy Act 1988 and is required to comply with the national privacy principles in respect of the collection of personal information from individuals.
    2. The personal information collected under the Video Ezy Website Membership program includes your name, address and email address which is required to enable us to properly conduct the VEW Membership including the award of Bonus Offers. It is optional for you to provide us with any additional personal information contained in the Registration. You will be eligible to receive VEW direct marketing material either by post or by email. If you indicate on the application form, or at any time thereafter, that you do not wish to receive this, it will not be sent to you.
    3. We will not disclose personal information collected about you to any other party outside of Video Ezy Australia (VEA).
    4. VE adheres to a strict internal policy code to ensure that privacy is adhered to. You may request access to the personal information we hold about you at any time and you may request us to amend you personal records if you believe the information to be incorrect.   7. Resolution of Disputes
    1. Any question or dispute regarding the Promotion or in connection with member's participation in the Promotion will be resolved by VE in its sole discretion.
  8. General
    1. In these terms and conditions: "VE" means Video Ezy Marketing and divisions of Video Ezy Australia Pty Ltd (ABN 74 073 076 294) or its authorised representatives. "Participating VE stores" means those Video Ezy stores from time to time participating in the Promotion.
    2. Employees and their immediate families, of Video Ezy Australia Pty Ltd (ABN 74 073 076 294), or its agents, contractors or franchisees, are ineligible to take part in the Promotion or apply for a VEW Membership.
    3. The promoter is Ezy Entertainment Marketing Pty Ltd (ABN 87 070 043 248) of PO Box 3531, Rhodes Shopping Centre, Rhodes NSW 2138. Permit Numbers will be issued for each promotion where necessary.
    4. Some titles on the VEW may not be available at all Video Ezy stores.

PROMOTIONAL OFFER TERMS AND CONDITIONS

Rental Guarantee:

‘Rent it now or rent it free' (If nominated title is unavailable for rent).

*A Free Overnight Rental Voucher will be issued for the nominated ‘Rental Guarantee' title if the nominated title is unavailable to rent. Normal membership & hiring conditions apply. Limited time only. Not valid in conjunction with any other offer. Limit of one voucher per membership. Not transferable or redeemable for cash. Only valid at store of issue. Late fees/Extended rental fees will be charged at the regular overnight new release rental rate. Offer only available from shelf date of nominated title. At participating Video Ezy stores. Excludes Blu-ray discs.

Price Guarantee:

‘You'll buy our Price Guarantee title for the cheapest price in Australia or we'll beat any lower advertised price by $1.' (Only applies to nominated Price Guarantee title).

*You may find a commercial advertisement by a competitor at a lower price than our advertised price in the 10 days from the advertised Video Ezy release date. If so, simply bring in the advertisement and if we haven't discounted our price already, we will beat the competitors advertisement by $1 instantly. A copy of the competitor's advertisement must be presented to obtain offer. In the event that you have already purchased an identical product from Video Ezy in the 10 days from the advertised Video Ezy release date we will refund you the difference plus $1(Excludes clearance and percentage off promotions).   • The customer must be a member of this Video Ezy store. Creating an account is easy. Please ask in-store. The customer is deemed to have agreed to the following terms:
    • Terms of Lay-by: Payments are required at least fortnightly and should consist of 3 or more instalments. The final payment must be received on or prior to the lay-by expiry date. If a lay-by is cancelled, the deposit is forfeited. When either the customer or Video Ezy cancels a lay-by, the customer has the right to a refund, less the deposit paid. The customer will not forfeit their deposit if the goods are unable to be supplied by Video Ezy.
    • Should the customer fail to honour the terms of the lay-by, such as not making regular payments or not paying the full amount by the agreed date, Video Ezy shall contact the customer in writing or by phone and provide the customer with 7 days in which to resolve the situation. Should the customer not resolve the situation within this 7 day period, their lay-by will be cancelled. The customer is entitled to a refund of any monies paid, less any deposit paid.
    • Video Ezy does not allow partial collections. The lay-by must be collected in full once final payment has been made.
    • It is the responsibility of the customer to advise Video Ezy of any change in their contact details.

VIDEO EZY WIN $1000 COMPETITION

Information on how to enter and prizes form part of the Terms and Conditions of Entry. Entry in the Video Ezy – Win $1000 Competition (the Promotion) is deemed acceptance of these Terms and Conditions of entry.

  1. Entry is open only to Australian residents residing in WA and NSW who are over the age of 18 years who are acurrent Video Ezy Member at the time of the Prize Draw (Eligible Entrant). Employees and their immediate families of the Promoter and agencies associated with these promotions are ineligible to enter. No responsibility is accepted for late, lost or misdirected entries. Entries that are not genuine, are incomplete, or ineligible will be declared void.
  2. Promotion opens 00:01 AM 1st November 2012 and entries close at 16:00 PM in each participating state on 16th December 2012 (“Promotion Period”).
  3. To enter the competition, an Eligible Entrant will be required to rent or buy any product available from a participating Video Ezy store during the Promotion Period, then complete the entry form located in store and deposit into the entry form box provided. All entries received in each participating store, will be entered into the relevant prize draw for that participating store.
  4. One entry per transaction will be permitted.
  5. There will be one (1) prize draw conducted at each participating Video Ezy store at 4pm (local time in each participating state) on 16th December 2012.
  6. The winning entrant must be in-store at 16:00 PM, 16th December 2012 to claim prize.
  7. The first valid entry drawn in each prize draw will win $1000.
  8. Prize pool value in each State/Territory is: WA: $35,000, NSW: $59,000 For a total maximum prize pool value of $94,000
  9. All prices are stated in Australian dollars. Prizes are not transferable or exchangeable and cannot be taken as cash. The sharing of the prize is not permitted.
  10. Prizes cannot be sold, scalped, auctioned, raffled, pledged or promoted as an inducement for any person or other entity to enter into any commercial or other arrangement with that third party. If this prize is obtained through any of these methods, it will not be honoured
  11. Winners will be notified by telephone and in writing within two (2) days of the prize draw and their name will be published in The Australian newspaper on 16th January 2013.
  12. The judges' decision is final and no correspondence will be entered into.
  13. By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed or filmed.
  14. In the event that the prize item is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation and accepts no responsibility for any variation in prizes.
  15. The prize will be awarded in the form of a cheque made payable to the name on the entry form.
  16. In the event that 20 x entries are drawn and a winner is not in-store to collect the prize, a second chance prize draw will be conducted at the same time and place of the original draw on 19th March 2013, subject to written directions from State Regulatory bodies. Winner’s names will be published in The Australian newspaper on 22nd March 2013.
  17. If an Eligible Entrant is selected as a winner, is found to be in breach of the Conditions of Entry a new winner may be selected and, in the event that the Eligible Entrant in breach has been awarded the prize, the Eligible Entrant may be required to return the prize or reimburse the full value of the prize to the Promoter.
  18. The Promoter Ezy Entertainment Marketing, Video Ezy and all related bodies corporate, officers, employees and agents shall not be liable for and shall be held harmless for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss), or for personal injury suffered or sustained, as a result of accepting the prizes, except for any liability which cannot be excluded by law.
  19. The Promoter and the agencies and companies associated with the Promoter accept no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.
  20. If the competition does not run for its duration due to, but not limited to, computer viruses, tampering, unauthorized intervention, fraud, technical failures or any other cause beyond the Promoter's control that corrupts or affects administration, security, fairness, natural disasters, act of God, or proper conduct of the competition, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the competition (subject to written directions from State Regulatory bodies) or disqualify any individual who tampers with the entry process.
  21. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of the competition.

VIDEO EZY 12 DAYS OF GIVING COMPETITION

  1. Information on how to enter forms part of the terms of entry. Entry into the 12 Days of Giving Promotion (the Competition) is deemed acceptance of these terms and conditions.
  2. Entry is open to all residents of Australia who are 15 years of age or older and have a Facebook account (Eligible Entrant).   3. The Competition commences on 10/12/12 at 00:01 (AEDST) and concludes on 21/12/12 at 23:59 (AEDST) (Promotion Period).

They will be prompted (and must do so) to enter their email address, full name, address, telephone number and the name of the prize draw that they would like to win to go into the draw for that specific prize draw. The prize draws will take place daily at Oxygen Marketing, Level 1, 16 Palmer Parade Cremorne VIC 3121 at 12:00 pm (midday) (AEST) on each day of the Promotion Period (December 10 to December 21). For the prize allocated on the 21st December, the draw will take place at 12:00 pm (midday) (AEDST), 22nd December at the same venue. For the prizes allocated on the 14th, 15th and 16th of December, the draw will take place at 12:00 pm (midday) (AEDST), 17th December at the same venue. Winners names will be published on the Video Ezy website – www.videoezy.com.au; the Video Ezy Facebook page – facebook.com/videoezy, and in the Video Ezy ‘Ezy Entertainment’ Magazine (February edition).
  11. The first valid entry drawn on each day of the Promotion Period will win the entire list of prizes allocated for that particular prize draw. The exception to this is the prize drawn on day 10, Wednesday 19th December, where the first ten valid entries will each win 1 x Free Flash Memberships.
  12. All prices stated are in Australian dollars, represent the recommended retail price (“RRP”) inclusive of GST and were correct at time of printing. The Promoter accepts no responsibility for change in prize value between the time of printing and the ultimate redemption date of the prize

  23. If a winner of a prize is under the age of 18 years, the prize will be awarded to the winner’s parent or guardian.
  24. The Promoter may conduct such further draws as are necessary at 5:00pm AEST on 21/03/12 at the same place as the original prize draw in order to distribute any prizes unclaimed by that date, subject to any written directions given under relevant State or Territory legislation. In the event of any winners, they will be contacted in writing and telephone within 7 days. Winner’s names will be published on videoezyonline.wordpress.com/
  25. The Promoter’s decision is final and the promoter will not enter into correspondence regarding the Competition result.
  26. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.
  27. It is a condition of accepting the prize that the winner shall look to the manufacturer for all warranties.
  28. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.
  29. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the entrant or for any of the equipment or programming associated with or utilised in this Competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this Competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

Ezy Entertainment Marketing, Franchise Entertainment Group, Oxygen Interactive Pty Ltd and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
  32. If for any reason this Competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to any written direction given under State Regulation.
  33. All entries become the property of the Promoter. The information provided by entrants will be used by the Promoter for the purpose of conducting the Promotion. The Promoter may disclose entrants' personal information to its contractors and agents to assist in conducting the Promotion or communicating with entrants and to State and Territory gaming authorities where required to do so.
  34. No responsibility will be accepted for late, lost or misdirected entries. All entries are deemed to be received at the time of the receipt into the Promoter’s database and NOT at the time of transmission by the entrant.
  35. The Promoter, Oxygen Interactive or any of its related entities or affiliates are not responsible for any problems or technical malfunction or computer online (or wireless) systems, servers, or providers, computer equipment, software, or technical problems resulting from participation or sending or receiving of any communication or of any materials in this Competition.
  36. Oxygen Interactive Pty Ltd, on behalf of Ezy Entertainment Marketing, is collecting the entrant's personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winner). The entrant's personal information may be disclosed to Oxygen Interactive Pty Ltd for this purpose. If you are not willing for this to occur you cannot participate in the Promotion.
  37. Entrants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation.
